Delivery time: up to 4 hours from the moment we receive the payment. It is important to clearly indicate the delivery address and the recipient`s contact information, as well as the desired delivery date and time. Please note that delivery time depends on the courier`s route and on the delivery address. If the recipient is not present at the delivery address, the Seller reserves the right to leave the parcel with a third person, upon a separate agreement with the Customer. Special delivery terms apply when the delivery must be made on 14 February, 8 March, or the Mother`s day. The orders to be delivered on these dates must be made 2-3 days in advance; otherwise the order will be delivered the next working day.

TERMS OF SALE AND DELIVERY:

Definitions

Seller – "Flamingo-D" LLC
Customer – a natural or legal person, which places an Order via Online Store.
Order – Customer`s purchase of selected Products and the accompanying request to deliver the Products to the Customer`s indicated address, all duly executed at the Online Store.
Products – physical goods that are in free circulation and that are offered for sale at the Online Store.
Online Store - the Internet site www.daugavpilsziedi.lv. The Online Store offers Customers the possibility to order Products from the Seller, and defines the terms of sale and delivery of the Products.

1. General Provisions
1.1. The owner and administrator of the Online Store is "Flamingo-D", LLC.
1.2. By ordering Products at the Online Store the Customer agrees to the terms of sale of Products (hereinafter – Terms of Sale), which are laid out below.
1.3. The Terms of Sale, as well as the information about the Products provided at the Online Store is public.
1.4. The relationships between the Customer and the Seller are governed by legislation of the Republic of Latvia.
1.5. The Seller reserves the right to amend these Terms of Sale.

2. Placing an Order
2.1. Customer can place an Order by phone, e-mail, via Internet Store, or in person providing the Seller with the necessary information.
2.2. If the Customer places an Order for a quantity of Products exceeding the quantity available at the Seller`s warehouse, the Seller will inform the Customer by sending an e-mail to the electronic address provided by the Customer during registration. In such situation the Customer has the right either to pay for and receive the Products in the quantity in which the Products are available, or to cancel the relevant position of the Order, or, as an alternative solution, to accept Seller`s proposal to postpone the Order until the specified Products are available at the Seller`s warehouse in necessary quantity. If the Customer does not inform the Seller of his choice within 3 working days, the Seller has the right to cancel the entire Order.
2.3. The information available at the Online Store may not fully reflect the characteristics of the Products (such as the colour, size, technical parameters, shape, etc.). The Seller is not responsible for precision of colour reproduction of the Client`s display. Before placing an Order the Customer has the right to approach the Seller and receive clarifications concerning the Products` details. If the Customer has not requested such detailed clarifications from the Seller, it is considered that the Customer has no doubt concerning the features of Products ordered.
2.4. If the Customer cancels an Order, which has been partly or fully paid but not shipped, the amount paid for the Order by the Customer will be returned within 5 working days.

3. Delivery
3.1. The delivery of Products is carried out on the date and at the location indicated in the Order.
3.2. The Products are delivered either to the Customer or to the person specified in the Order as the recipient.
3.3. The delivery time of Products is conditional on the timely payment by the Client, on the chosen type of delivery, on the address, and on nuances of work of the delivery service, which ensures the delivery of the Order and is not directly dependent on the Seller.
3.4. The Seller shall make every effort to ensure that the Products are delivered on time; however, delays in delivery of the Products are possible due to reasons beyond Seller`s control.
3.5. In cases where the Products are not delivered to the Customer due to fault of mail (courier) service, the Seller shall reimburse the Customer the value of the Products only after the Seller receives the proof of loss from the mail (courier) service.
3.6. Delivery options are listed at the Online Store.
3.7. The price of delivery of each Order is calculated taking into consideration the weight of the Products or of the whole Order, the delivery type and the address, and is indicated in the Online Store during the last stage of placing an Order.

4. Payment
4.1. The prices of the Products are indicated at the Online Store. If the price of the ordered Products is incorrect, the Seller shall notify the Customer about this at the earliest opportunity in order to cancel or confirm the Customer`s Order. If it is impossible to contact the Customer, the Order will be considered cancelled. If the Order has been paid for, the Seller shall return the payment amount within 5 working days.
4.2. The Order is accepted for processing only after the full prices of the Order is paid to the Seller.
4.3. At the Online Store the payment is made by Visa or MasterCard bank cards, or via PayPal payment system via bank transfer at the time of placing an Order.
4.4. The Seller has the right to offer discounts to the Customer and to offer to participate in customer loyalty programs. The Seller is entitled to amend the conditions of the customer loyalty program unilaterally.

5. Intellectual property
It is prohibited to copy any and all textual information and graphical images published on the Online Store.

6. Warranty and liability
6.1. The Seller shall not be liable for Client`s losses resulting from the incorrect use of the Products.
6.2. The Seller is not responsible for the content and functionality of external websites.
6.3. The Seller has the right to transfer its rights and obligations towards the Customer to third parties.

7. Use of Customer`s personal data, confidentiality and security
7.1. The Seller may use Customer`s personal data for the purposes of:
- Customer registration at the Online Store;
- Performance of Seller`s obligations towards the Customer;
- Evaluation and analysis of the performance of the Online Store;
- Informing the Customer about new Products and promotions.
7.2. Seller shall not disclose the information received from the Customer to third parties. The transfer of Customer`s information to the agents and third parties, which act in accordance with the contracts with the Seller in order to fulfil the Seller`s obligations towards the Client, shall be considered legitimate.
7.3. The disclosure of information within the limits established by the Latvian legislation, shall not be considered a violation.
7.4. The Seller collects IP address information of the users of the Online Store. This information is not used for the purposes of determining the identity of the users of the Online Store.
7.5. The Seller is not responsible for the Customer`s information provided in public manner at the Online Store.

8. Other provisions
8.1. In case of questions or dispute, the Customer may approach the Seller by phone: +371 6 54 26 204 or via e-mail topziedi@gmail.com.
8.2. All disputes between the Seller and the Customer shall be solved through negotiations. If an agreement cannot be reached, the dispute shall be referred to the court in accordance with Latvian legislation.
